Under the “DUI per se” law, drivers are considered intoxicated if a breath or blood test reveals a blood alcohol content (BAC) above a certain level. This applies even if the driver does not appear physically or mentally impaired. The BAC at which a driver is considered intoxicated per se varies:
- Drivers under age 21 – .02
- Commercial drivers – .04
- All other drivers – .08
