When does a DUI become a felony?
In most cases, a DUI charge is considered to be a misdemeanor. However, if the situation falls into any of the following circumstances, then the person at fault may be charged with a felony:
- Three or more DUI convictions within a seven year time frame
- DUI while possessing any amount of an illegal drug
- DUI accident that causes a significant amount of bodily harm or death to another person
