Drunk driving checkpoints

by Administrator 20. November 2009 02:14

Do police officers target drunk drivers? The simple answer: Yes.

Police will often set up checkpoints in areas where they suspect drunk driving to occur. These checkpoints often include intersections near bars, sports stadiums, or concert venues.

Police set up checkpoints in these areas because they believe there is a high likelihood of drunk driving. For this reason, people who drink around these areas should avoid driving and use alternative means of transportation, such as a taxi.

If you or anyone you know has been charged with drunk driving, contact the Las Vegas drunk driving lawyers of William Palmer & Associates, P.C., at 702-888-2222.

The use of ignition interlock devices

by Administrator 20. November 2009 02:03

When someone is arrested for a DUI, they may receive certain penalties if they are convicted. These penalties could include prison time, financial penalties, and even an ignition interlock device requirement.

These devices force former DUI convicts to perform a breath-test before the vehicle starts. The use of this device, however, depends on laws that vary from state to state.

Is there a national BAC level?

by Administrator 20. November 2009 01:59

Yes and no. For the most parts, states set their own blood alochol content levels for people over the age of 21. If someone exceeds these limits, then he or she could receive a DUI.

The BAC in most states is 0.08, while in a few states the BAC is 0.10. However, Congress has tried to encourage states to pass a lower BAC level by tying highway funds to compliance.

The zero tolerance policy for underage drunk driving

by Administrator 6. November 2009 03:31

Underage drunk driving is often met with zero tolerance in most states. If a driver is underage and has any discernable alcohol in his system, then that driver will likely face serious penalties.

At a minimum, the driver will likely receive a license suspension, a fine, community service, and possilbe jail time. If the officer also finds alcohol in the car, then the driver could face a charge of alcohol possession, which will likely increase the severity of the penalty.

How to challenge a license suspension

by Administrator 6. November 2009 03:19

When individuals are convicted of drunk driving-related charge, they may receive a license suspension. When this occurs, many individuals do not try to contest the suspension.

However, in most cases, individuals have the legal right to contest the suspension. In order to do, they must request a hearing with the Department of Public Safety. During this hearing, individuals have the opportunity to challenge the  suspension and offer arguments in favor of their cause.

If you or anyone you know has received a license suspension, contact the Las Vegas DUI lawyers of Palmer & Associates, P.C., at 702-888-2222.
